Introduction

Welcome to SYP, the website for the High School Ministry of Times Square Church in New York City.

This Terms of Use Agreement provides the legally binding terms, or the rules for your use of SYP. When you use SYP, you agree to be bound by these rules. If you do not agree or cannot comply with these rules, you cannot use SYP.

SYP will not post your telephone number, street address, last name, or anything that would allow someone you don’t know to find out that information.

SYP reserves the exclusive right to determine what submitted material, including but not limited to, questions, comments, testimonies, poetry, music, artwork, video, photography, etc., will be posted on the site.

Eligibility

  1. You must be 13 years of age or older to use SYP. When you use SYP, you are promising that you are 13 or older, and can understand and obey the rules in this agreement.
  2. You also promise that you are either over 18 or have the permission of your parent(s) and/or your guardian to use SYP, and are able to understand and obey the rules about SYP. If you need help understanding the rules, ask your parents for help or call Lane Paulsen at 212-541-6300.

Proprietary Rights

  1. When you submit a song, a drawing, a poem, or any other material to SYP, you give SYP a limited license to use, modify, publicly perform and display, reproduce and distribute the material on SYP. This means that you still own the material, but you have given SYP permission to allow other users of SYP to listen to, look at, or read your material. This license is non-exclusive (you can license your material to anyone else), royalty-free (SYP does not have to pay you for the use of your material), and worldwide (because the Internet is global). This license ends when you remove the material from SYP. SYP cannot sell your material, nor distribute it outside SYP.org.
  2. When you submit material, you warrant, or promise, that: (i) you own the materials posted (you wrote the song) or you have the right to grant the license, and (ii) posting the material does not violate the privacy, publicity, contract, or any other rights of another person. If you post material on SYP that does not belong to you, you are responsible for paying the royalties, fees, and any other money due to any person because of your posting.
  3. You may not copy, modify, translate, publish, distribute or perform any content posted on SYP without written permission from the creator of the content.
  4. If you think your work has been copied and posted on SYP in a way that violates your rights, please provide our Copyright Agent with the following information:
    • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
    • A description of the copyrighted work that you believe has been infringed;
    • A description of where the material that you claim is infringing is located on SYP;
    • Your address, telephone number, and e-mail address;
    • A written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, his/her agent, or the law;
    • A statement by you, under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Indemnity

You agree to indemnify and hold SYP and Times Square Church harmless from any loss, liability, claim or demand made because of your use of SYP in violation of this agreement.

Limitation on Liability

In no event will SYP.com be liable to you or any third party for any indirect, consequential, incidental, special or punitive damages, including lost profit damages arising from your use of the services. Regardless, SYP.com’s liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you for membership or use of SYP.org.

Acceptance

You accept this agreement when you use SYP, and you communicate your acceptance when you register as a user of the website. This is the entire agreement between you and SYP regarding your use of SYP.org.
